1. Acceptance of Terms
Welcome to FastMind.ai! By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms applicable to certain programs in which you may elect to participate. If you do not agree to these Terms, you may not use our services.
2. Description of Service
FastMind.ai ("we", "us", "our") provides a software-as-a-service (SaaS) platform that allows users ("you", "your", "user", "subscriber") to add AI-powered chatbots to their websites to answer user questions about their products. This service is provided on a recurring subscription basis.
3. Account Registration
To access our services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account login credentials and are fully responsible for any activities or actions under your account, whether or not you have authorized such activities or actions.
4. Subscription and Payment
4.1 Recurring Payments
FastMind.ai operates on a recurring subscription model. By subscribing to our service, you agree to pay the applicable subscription fees as they become due plus all related taxes, and to reimburse us for all collection costs and interest for any overdue amounts.
4.2 Billing
You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the subscription plan you select. Billing cycles are set on a monthly or annual basis.
4.3 Price Changes
FastMind.ai, in its sole discretion and at any time, may modify the subscription fees for the subscriptions. Any subscription fee change will become effective at the end of the then-current billing cycle. We will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to terminate your subscription before such change becomes effective.
4.4 Refunds
Except when required by law, paid subscription fees are non-refundable.
5. User Responsibilities
5.1 Compliance
You agree to comply with all applicable laws, regulations, and industry standards in connection with your use of our services.
5.2 Content
You are responsible for all content and data provided by you or your end-users to FastMind.ai. You represent and warrant that you have the necessary rights and permissions to use such content and data with our services.
5.3 Prohibited Activities
You agree not to misuse the services. For example, you must not, and must not attempt to, use the services to do the following things:
- Probe, scan, or test the vulnerability of any system or network.
- Breach or otherwise circumvent any security or authentication measures.
- Access, tamper with, or use non-public areas or parts of the services.
- Interfere with or disrupt any user, host, or network.
- Plant malware or otherwise use the services to distribute malware.
- Access or search the services by any means other than our publicly supported interfaces.
6. Intellectual Property
The service and its original content, features, and functionality are and will remain the exclusive property of FastMind.ai and its licensors. The service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FastMind.ai.
7. Termination
7.1 Termination by User
You may terminate your subscription at any time. Your termination will take effect at the end of the current billing cycle, and you will not be entitled to a refund for any subscription fees already paid.
7.2 Termination by FastMind.ai
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
8. Limitation of Liability
In no event shall FastMind.ai, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
9. Disclaimer
Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the state in which FastMind.ai is incorporated, without regard to its conflict of law provisions.
11. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
